Labour Market Testing (LMT)
Australian employers who seek to nominate/sponsor a skilled overseas worker MUST undertake LMT, unless a specific exemption applies. (See below)
The current LMT requirements for subclass 482 and 494 employer nominations are:
- three adverts, which must run for at least 28 days each
- online adverts should appear on dedicated online jobsites, including Seek, LinkedIn, Indeed etc. and some government jobsites.
- one of the three adverts must appear on the government’s Workforce Australia jobsite https://www.workforceaustralia.gov.au/
- the adverts should always contain the following information:
- the job title and position description, including where the job is based
- the skills or experience required for the position
- the name of the approved sponsor/employer or recruitment agency used by the sponsor
- the salary or salary range for the position if the annual salary is lower than $96,400
LMT is essential for 482 and 494 nominations AND:
- the 28 days of advertising must be completed before a nomination application is submitted, and
- the 28 days must run within the 4 months before the nomination application is submitted, and
- the visa applicant’s contract of employment must be dated AFTER the 28 days of advertising is concluded.
If the LMT is not compliant, the nomination application is likely to be refused and all monies lost
